What is dangerous driving?

Dangerous driving under section 2 of the Road Traffic Act 1988 can include a number of different kinds of reckless and dangerous behaviour on the part of a motorist. Examples include:

 

  • dangerous overtaking (or undertaking)

  • wilfully ignoring road signs and traffic lights

  • driving in a manner which is aggressive to fellow road-users

  • racing and serious speeding offences

  • knowing driving a vehicle that is not safe to drive

  • using a mobile device whilst driving

 

For you to be convicted of dangerous driving, the prosecution must prove that you were driving at a standard which is far below the minimum standard of driving which should be expected of a safe and competent driver, and that it would be obvious to any competent driver that the manner in which you were driving was dangerous.

Sentencing

A dangerous driving charge can be heard in the Magistrates Court or the Crown Court, depending on the seriousness of the offence. Because of the seriousness of the offence, the Courts can issue harsh sentences: on conviction in the Crown Court you could be sentenced up to 2 year - with additional and often lengthy periods of being disqualified from driving. Even when you are permitted to drive again, you are likely to have to take a series of re-tests in order to apply for your licence. The effect on your life will be very serious – particularly if you rely on being able to drive for your work.
